Trademark Application Process - Step 2

Will the trademark be owned by an individual or an entity such as a corporation or LLC?

Identify the owner of the trademark. This is the person or organization who will be the owner of record. If you choose individuals, you can enter as many names as you want who own the mark. With an organization, you will have to identify someone to be the person of contact for the organization.

Choose Your Trademark Class

Describe the goods and services related to your mark. We compare the description you provide and automatically provides descriptions from the USPTO ID Manual for your consideration.

Do you sell, or intend to sell, a good or service?

When describing your products and services, be specific and do not use terms such as "including but not limited to," "like," "such as," and "etc." Using such terms can delay your application

Trademark Application Process - Step 4

Know before you file! Get a Comprehensive Search Report.

It is highly recommended that you should do a comprehensive search to see if your mark or a similar mark is already in use or registered by someone else. A quick search will only help to avoid obvious duplication of pre-existing marks. If there is a direct-hit search result for an existing or pending application we will let you know before any fees are paid to the USPTO so you can re-evaluate your mark choice or whether you want to move forward with the trademark process. If your company is just beginning, it's better to make name changes now rather than invest years building a brand only to learn that you have to change the name and lose all of your goodwill.

A detailed search comes with legal advice from a lawyer. You will then be in a better position to make better choices. If you pick one of these options, you will still complete the application now. However, no application will be filed with the USPTO until you have had a chance to review any of the paid searches, approve the application in light of the searches or easily come back here and make some changes before your application is filed. The paid searches come with legal advice as to how you should proceed. This are only Included with Premium or Autopilot Package
